1. Acceptance of Terms

By accessing or using Ghostbar ("Service"), including the desktop application, website at ghostbar.app, and related APIs, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and the operator of Ghostbar ("we", "us", "our").

2. Description of Service

Ghostbar provides a desktop overlay application that may capture screen context, audio transcription, and AI-generated responses. Cloud features require a paid plan or trial. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. Eligibility and Account

• You must be at least 18 years old and capable of forming a binding contract.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity under your account.
• You must provide accurate registration information.

4. Acceptable Use

You agree to use Ghostbar only in compliance with applicable laws and third-party terms. You may not:

• Use the Service in ways that violate employer policies, academic honor codes, or platform rules.
• Harass others, distribute malware, or reverse-engineer our systems.
• Circumvent usage limits, resell access, or scrape our API without authorization.

You are solely responsible for determining whether your use is permitted in your context. We do not encourage cheating, misrepresentation, or violation of interview integrity policies.

5. Payments, Subscriptions, and Refunds

• Paid plans are billed in Indian Rupees (INR) for customers in India and US Dollars (USD) for international customers, processed via Razorpay.
• Subscriptions renew monthly until cancelled from your dashboard.
• Trial packs are one-time purchases with usage limits as described at purchase.
• Except where required by law, fees are non-refundable once the Service has been accessed or cloud quota consumed.
• We may change pricing with reasonable notice; continued use after changes constitutes acceptance.

6. AI Output Disclaimer

Responses generated by large language models may be inaccurate, incomplete, or outdated. Ghostbar does not guarantee the correctness, safety, or suitability of AI output for any purpose. You must independently verify all information before relying on it in professional, academic, medical, legal, or financial contexts.

7. Privacy and Data

Our handling of personal data is described in the Privacy Policy. By using cloud features, you acknowledge that questions, screen context, and related content may be transmitted to our servers and third-party AI providers (OpenAI, Anthropic) as necessary to fulfill your request.

8. Intellectual Property

The Service, including software, branding, documentation, and website content, is owned by us or our licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the desktop app and website for personal or internal business use in accordance with these Terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE OVERLAY WILL BE INVISIBLE IN ALL SCREEN-SHARING SCENARIOS. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, EMPLOYMENT OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) INR 5,000.

11. Indemnification

You agree to indemnify, defend, and hold harmless us and our affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, or any dispute between you and an employer, educational institution, or other party related to your use of Ghostbar.

12. Termination

• We may suspend or terminate your access immediately for violation of these Terms, suspected fraud, or abuse of quotas.
• You may cancel subscriptions via the dashboard at any time.
• Upon termination, your right to use the Service ceases.
• Provisions that by nature should survive (disclaimers, limitation of liability, indemnification) will survive termination.

13. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka, India, unless mandatory consumer protection law in your jurisdiction requires otherwise.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use after changes constitutes acceptance. If you disagree, you must stop using the Service.
